The Health Information Portability and Accountability Act (“HIPAA”) is a statute that was passed by Congress in 1996. It governs health related information, which means any information, that:

(1)   is created or received by a health care provider, health plan, public health authority, employer, life insurer, school or university, health care clearinghouse, or a health care provider who transmits any health information in electronic form in connection with a healthcare transaction; and

(2)   relates to the past, present, or future physical or mental health or condition of an individual; the provision of health care to an individual; or the past, present, or future payment for the provision of health care to an individual.

Organizations that provide services to health plans, public health authorities and others who have access to such health related information are generally subject to HIPAA either as a Business Associate of a Covered Entity or a subcontractor of a Business Associate.

We understand the security and privacy requirements set forth in HIPAA and the Health Information Technology for Economic and Clinical Health Act.
